Felony Reduction and Expungement, FBI Record Corrected
Case Background
Our client had an older criminal record that included a felony Attempt to Elude conviction, along with other criminal convictions. We pursued two forms of relief on the client's behalf: reduction of the felony conviction to a misdemeanor and expungement of eligible cases.
Those court filings were successful. The felony conviction was reduced to a misdemeanor, and the eligible matters were set aside. However, obtaining favorable court orders was only part of the work required to fully correct the client's record.
When we later reviewed the client's criminal-history information, we found that the state record did not accurately reflect all the relief that had been granted. An improper flag remained on the record, and part of the arrest history also needed correction. This meant the client's background record still did not fully match the court results.
Rights Restoration Outcome
We followed up with Oregon State Police to address the reporting errors and provided the information needed to correct the criminal-history record. Oregon State Police then updated the record and confirmed that the improper flag had been removed.
We also obtained additional FBI background reports to make sure the corrected information carried through to the federal record. After further review, the final FBI report confirmed that the record had been properly updated and the prior flag was no longer present.
The matter shows why successful reduction and expungement orders require additional follow-through. In this case, we not only obtained the court relief, but also worked through the state and federal record-correction process so the client's official criminal history accurately reflected the results.
