Set-Aside Granted Despite Sex Crime Classification Dispute
Case Background
Our client sought to set aside a prior conviction, but the State objected on the ground that the conviction should be classified as a “sex crime” under Oregon law. If that classification applied, our client would have been statutorily ineligible for a set-aside.
The difficulty was that the conviction fell into a legal grey area. Depending on the specific findings associated with the offense, it could potentially be treated as either a sex crime or a non-sex crime. That distinction was outcome-determinative: if the conviction qualified as a sex crime, the petition could not proceed; if it did not, our client remained eligible for relief.
A key part of the analysis was the original plea agreement. The plea documents reflected that the parties had agreed to a disposition that did not classify the offense as a sex crime. That agreement became central when the State later took a different position during the set-aside proceeding.
Rights Restoration Outcome
We filed supplemental briefing responding to the State's objection. We argued that the original plea agreement was binding and that the State could not later treat the conviction as a sex crime when the negotiated disposition had specifically excluded that classification. We also addressed the statutory definitions governing set-aside eligibility and the additional findings required for the conviction to qualify as a sex crime.
The court accepted our position, the State's objection was overcome, and the conviction was successfully set aside.
This case shows how expungement eligibility can depend on more than the title of an offense. Where a conviction falls into an ambiguous statutory category, careful review of the original plea agreement and the precise legal findings can determine whether a person remains eligible to clear the conviction from their record.
