Relief From Sex Offender Registration Granted
Case Background
Our client sought relief from a long-standing sex offender registration requirement arising from a close-in-age, “Romeo and Juliet” situation. The client and the other person were less than four years apart in age, and the registration obligation stemmed from conduct that was unlawful because of the younger person's age.
The eligibility analysis was unusually technical because the client had two separate convictions in two different criminal cases, but both involved the same person. The statute required careful analysis of whether the second conviction created a disqualifying barrier to relief.
The key issue was that the second case did not involve a different victim. Because both convictions arose from conduct involving the same person, the client could still meet the statutory eligibility requirements for relief from registration.
Rights Restoration Outcome
We petitioned for relief from the registration requirement under ORS 163A.140 and ORS 163A.150, addressing each statutory eligibility requirement and, in particular, the significance of the two convictions involving a single victim. The petition established that the client had not been convicted of another disqualifying sex crime involving another victim.
The client successfully obtained relief from the sex offender registration requirement. The case is significant because two convictions in two separate cases did not automatically defeat eligibility. The analysis turned on the precise statutory language and the underlying facts—including that both convictions involved the same victim.
This matter illustrates why relief-from-registration cases often require more than a surface-level review of a criminal record. The number of cases or convictions alone may not answer the eligibility question; the relationship between those convictions, the victim or victims involved, and the statute's specific requirements can be decisive.
