Felony Reduction and Expungement Restore a Job Offer
Case Background
Our client had an older criminal history that included a felony DUII conviction and a separate case that was eligible to be set aside. We first pursued expungement and reduction.
The felony reduction was contested. The State initially opposed reducing the DUII conviction, relying on a general policy against reductions of felony DUII offenses. We responded with written briefing emphasizing that the court could consider our client's individual circumstances rather than applying a blanket rule. The record showed that the conviction was more than 15 years old and that our client had demonstrated long-term stability without subsequent criminal activity. Our motion was granted, and the felony was ultimately reduced to a misdemeanor.
In a separate matter, we also pursued expungement of an eligible conviction. The State did not oppose that request, and the court entered a signed set-aside order.
Rights Restoration Outcome
Those successful court outcomes became especially important later when our client encountered a problem with an employment background check. Despite the earlier legal relief, information appearing in the background-check process created an issue with a job opportunity.
We contacted the background-screening company directly and provided documentation explaining the corrected status of our client's record. The screening company opened an internal review and began working to address the issue.
The next day, our client reported that the employer had reoffered the position. This matter illustrates why rights-restoration work sometimes extends beyond obtaining a court order. A successful reduction or expungement may still require follow-through when outdated or inaccurate background information affects employment. In this case, we were able to address both the underlying convictions and, later, the practical employment consequences when the corrected record was not being reflected as it should have been.
