Expungement and Firearm Rights Restoration in Lane County
Case Background
Our client sought relief from several older Lane County convictions, including Unauthorized Use of a Vehicle, Theft, and Fleeing or Attempting to Elude a Police Officer. The goal was not only to clear eligible convictions from the record, but also to address firearm rights.
The matter required more than a single court filing. We pursued set-aside relief for the eligible convictions and separately sought restoration of the client's Oregon firearm rights. Both forms of relief were successfully obtained.
A further complication arose after the court relief was granted. The client's FBI identification record continued to reflect arrests or charges in a way that did not fully correspond with the updated state-court record. That meant the practical work was not finished when the court orders were entered.
Rights Restoration Outcome
We successfully obtained orders setting aside the eligible convictions and restoring the client's Oregon firearm rights. We then continued reviewing the client's background records to identify discrepancies between the court record and the information still appearing on the FBI report.
The matter required additional administrative follow-up to make sure the client's criminal history accurately reflected the relief already granted by the courts. This kind of post-order work can be important because an expungement or rights-restoration order does not always result in every background database being updated immediately or correctly.
For the client, the case involved both substantive legal relief and the follow-through necessary to make that relief meaningful in practice.
