Enforcing a Court-Ordered License Restoration Through the DMV
Case Background
Our client successfully obtained a court order restoring his driving privileges after prior DUII convictions. However, after the order was signed, our client encountered an extended administrative problem with the DMV. Despite the court's ruling, the DMV repeatedly indicated that it had not received the judgment necessary to process the restoration. As a result, the client remained unable to obtain his license even though the court had already granted relief.
The difficulty was not a new legal dispute about whether the client qualified for restoration. Instead, it was an implementation problem: making sure the court's order reached the correct DMV personnel and was recognized within the agency's suspension system.
Rights Restoration Outcome
We continued working on the matter after the court case was effectively over. That included repeated coordination with court staff and the DMV, identifying the appropriate suspension-unit contacts, and arranging for the restoration order to be transmitted to the specific DMV channels needed to move the process forward.
The client later encountered another administrative issue at the end of his five-year ignition interlock requirement. Although he reported no new arrests or driving-related problems, his interlock provider raised an issue related to removal of the device. We helped him identify the appropriate DMV suspension contact so he could confirm his status and address the provider's position.
Fortunately, DMV will now accept orders from our office and not only the court, so this kind of problem no longer generally occurs.
This matter illustrates an important practical point: obtaining a favorable court order does not always end the process. In some cases, additional follow-through with agencies and service providers is necessary to make sure the relief granted by the court is actually implemented.
