Decades-Old Felony Reduced, Conviction Set Aside
Case Background
The client sought to address the continuing effects of an older criminal record that included a felony Driving While Suspended conviction from 1990 and a separate assault conviction. Although the convictions were decades old, their presence continued to affect the client's legal status and affected firearm rights.
The strategy required addressing the convictions separately. For the non-expungable driving offense, we sought reduction of the felony conviction to a Class A misdemeanor. For the assault conviction, we pursued a set aside, commonly referred to as an expungement.
In support of the requested relief, the matter emphasized the client's substantial evidence of long-term rehabilitation. Character references described a lengthy stable work history, personal integrity, service as a caregiver for elderly individuals, and a positive driving history. These circumstances helped provide the broader context for convictions that had occurred many years earlier.
Rights Restoration Outcome
The felony Driving While Suspended conviction was successfully reduced to a Class A misdemeanor, and a superseding judgment reflecting the reduction was entered. The separate assault conviction was also successfully set aside.
Following those results, we reviewed the effect of the updated record on the client's record and firearm rights and advised that all rights were restored.
An important final step was confirming that the changes were accurately reflected in criminal-history records. Updated FBI records were reviewed and confirmed to show the corrected disposition. This record review process helped ensure that the practical effect of the court orders was reflected beyond the court file itself.
