Contested Felony Reduction and License Restoration
Case Background
Our client sought two forms of relief arising from an older criminal case: reduction of a felony conviction and restoration of her driving privileges. The underlying case included a felony DUII and reckless endangering conviction, and those convictions continued to affect her ability to move forward years later.
Rather than handling the matters separately, we pursued the felony reduction and driving-privilege restoration together. That approach allowed the related issues to be presented in a coordinated proceeding and avoided the added expense of litigating them independently.
The case was contested. The State opposed the requested relief, so the outcome was not simply administrative or agreed upon. We had to present the client's rehabilitation and circumstances to the court and explain why both forms of relief were appropriate despite the State's objection.
Rights Restoration Outcome
At the hearing, we argued both the felony reduction and the restoration of driving privileges as part of the same overall effort to remove the continuing consequences of the prior case. The court granted the requested relief.
As a result, the qualifying felony conviction was reduced and the client was able to move forward with restoration of her driving privileges. The combined approach was important not only strategically, but practically: it allowed the client to address two significant legal barriers in a single coordinated proceeding, reducing unnecessary duplication and legal expense.
This case is a useful example of how related post-conviction remedies can sometimes be pursued together, even when the State opposes the relief, to create a more efficient path toward restoring important rights and reducing the long-term impact of an old conviction.
