Concealed Handgun Denial Reversed Before Appeal Was Filed
Case Background
Our client had a single prior felony conviction that initially affected eligibility for an Oregon concealed handgun license. Since that conviction, however, the client had obtained both restoration of firearm rights and relief from sex-offender registration.
The concealed handgun license denial was based on the underlying conviction. That created an important legal distinction. The earlier firearm-rights restoration removed the conviction as a mandatory basis for denial under ORS 166.291, leaving only the Sheriff's discretionary authority under ORS 166.293. The client's later relief from registration was also significant because it followed a finding that supported rehabilitation and lack of dangerousness.
The issue therefore was not simply the existence of an old conviction, but whether the client's history, viewed in light of the relief already obtained, could still support a discretionary finding sufficient to deny the license.
Rights Restoration Outcome
We prepared an appeal and provided county counsel with an advance copy before filing it. We explained why the prior conviction no longer supplied a mandatory basis for denial and why the remaining discretionary grounds were unlikely to support the Sheriff's decision.
After reviewing the matter, county counsel agreed that the client's history likely would not sustain the denial. The Sheriff's Office offered to reconsider the decision and granted the concealed handgun license application. The result avoided unnecessary cost and court proceedings while securing the practical relief the client sought.
